Criminal Litigation
Being arrested and charged by the police is a harrowing experience for most. At D’Arcy Sloman Peacock Lawyers, Vince will be there with you from the start of the process, defending you and advising you of your rights.
We represent clients who have been charged by the Police and whose matters are listed before the Local Court. Our practice areas range from Drink Driving pleas, Assault charges, Bail applications for any type of charge when bail refused by the police and Apprehended Violence Orders (Police or Private applications). Basically we provide representation for any criminal matter that starts in the Local Court. If you enter a plea of guilty to the charge you have before the Local Court, Vince himself will represent you from start to finish.
If your charge involves a plea of not guilty, Vince along with a barrister will represent you at the final hearing. Vince will however handle all the interlocutory adjournments prior to the final hearing. In regard to the selection of Barristers, we have a small number of highly trained barristers at our disposal at reduced rates. In criminal matters we only brief barristers who solely practice in Criminal Law unless the client wishes to appoint their own Barrister.
In relation to matters in the higher courts, being the District Court, Supreme Court and Court of Criminal Appeal, Vince will represent clients in these jurisdictions with instructing barristers “to do the talking in court.” In these jurisdictions, Vince will only appear without a Barrister in District Court severity appeals, which are appeals against a sentence received in that court.
Civil Litigation
Whilst Vince spends a lot of his time representing people in Criminal matters, he still likes to balance his criminal files with a healthy load of civil litigation but over the years has narrowed the types of civil matters he now takes on.
Vince is pleased to offer the following services in Civil Litigation:
- Matters commenced in the Local and District Court by way of a Statement
of Claim with an emphasis on matters involving Building Disputes.
- Matters commenced in the Consumer Trader and Tenancy Tribunal with an
emphasis with matters in the Home Building Division.
- Supreme Court Possession Claim matters, acting for either the lender or borrower.
